Most Client and/or MSP contracts include a provision regarding audits, allowing the Client or MSP to request extensive documentation regarding: (1) pay; (2) citizenship status; (3) immigration status; and (4) employment authorization, including I-9s and E-Verify results. You may have similar provisions in your own subcontracts.  This session will discuss the circumstances in which these requests are appropriate and how best to comply with these requests without violating other legal requirements.


Helen L. Konrad, Esq., is a director in the immigration practice group of the law firm McCandlish Holton PC. At the firm, she concentrates on work site compliance (including questions relating to the Form I-9 and E-Verify), as well as employment-based and professional immigration. Update from the NJSA Legal Legislative Committee on Trenton's Sick Leave Ordinanc


On April 16, 2015 a NJ Superior Court upheld Trenton's new Paid Sick Leave Ordinance with one important clarification that impacts employers doing business in Trenton.  The City of Trenton stipulated in court that the ordinance would apply ONLY to employers with physical locations within the city limits.  Therefore if you are a staffing firm with an office located in Trenton NJ, you will have to comply with the ordinance once the city publishes guidance to Trenton's employers.  But a staffing firm that does not have an office in Trenton (even if they do business with clients in the City of Trenton) does not have to comply with Trenton's Paid Sick Leave ordinance.

Even though the paid sick leave ordinance was scheduled to go into effect in March 2015, the City of Trenton has not yet issued any guidelines to employers.  Trenton reportedly is now prepared to distribute this information following this court decision.


Note that the Paid Sick Leave ordinance passed by Bloomfield, NJ in March (click here for a copy of the Bloomfield ordinance) will go into effect in early July and has many of the same issues of the Trenton law.  If your firm has a location or does business in Bloomfield, you need to make preparations for this new ordinance.
