Implementation of Trenton's Paid Sick Leave Ordinance is Delayed

The March 4, 2015 scheduled implementation of Trenton's ordinance requiring staffing firms (and other private employers) to provide paid sick leave benefits to any employee who performs services within the city limits of Trenton in excess of 80 hours in a calendar year has been delayed. A staffing firm providing even one employee who worked 80 or more hours at a location within Trenton's City Limits would be subject to Trenton's ordinance. Note the ordinance would apply even if the staffing firm did not have to have an office location in Trenton. Also, the covered employee does not have to live in Trenton. Violations of the ordinance are subject to both monetary and jail time penalties.

Six New Jersey-based business associations had filed a legal complaint on March 2, 2015 to overturn the Trenton's paid sick leave ordinance and the City of Trenton has agreed to postpone implementation at least until the court hearing on the complaint scheduled for April 9, 2015.

The New Jersey Staffing Alliance is a member of the Keep NJ Competitive business coalition working to prevent enactment of a statewide Paid Sick Leave law.
