A-1117/S-1397 - "New Jersey Schedules That Work Act"
Staffing Firms Cannot Comply With Its Proposed Requirements

Last week the Assembly Women and Children Committee approved A-1117 and sent it back to the Assembly.  This bill (and its duplicate in the Senate) would create significant administrative and management hardships and additional payroll expense for a sizeable portion of New Jersey's businesses, including some staffing firms.  The staffing industry, due to the nature of its client relationships and services, cannot comply with the proposed legislation as it is currently drafted.  Another major concern is that if this legislation is signed into law, then the state legislature can easily extend coverage to more occupational categories - impacting more and more staffing firms.

Please take a few moments and review several documents prepared by the NJSA Legal Legislative Committee to increase your understanding of the issues and NJSA's position on the matter.

  • NJSA's Position Paper on this proposed bill that will be sent by NJSA to the Legislature and Governor's Office,

NJSA is expecting other NJ business associations, such as the restaurant association, etc., will address the issues impacting the more traditional employers created by this bill.  NJSA wants to focus its conversation solely on the inability of the non-traditional staffing industry to comply with its requirements.

The NJSA Legal Legislative Committee encourages each of you to contact your state representatives (Assembly and Senate) and advise them of your concerns.  Your communications will make these concerns more locally relevant to your representatives.  Even if you are not currently providing temporary services in these occupational categories, remember how easy other categories such as yours could be added in the future if it passes. 

We will continue to keep you informed on this legislation and other bills that may impact the staffing industry and your firms.
