Update on A3912 - a bill that will empower NJ's municipalities and counties to establish minimum wage levels for private employers in their jurisdictions

On March 19th the Assembly Labor Committee heard testimony from various groups regarding A3912.NJSA joined with other business organizations such as NJBIA, the NJ State Chamber, Retail Merchants Association, and others to argue against approval of this proposed legislation. The committee ended up voting along party lines 6 to 3 to release the bill to the Assembly. But several of the Democrat committee members did express reservations about the bill in its present form.


Unfortunately, the bill was released back to the Assembly without any amendments or adjustments and remains a major concern for private business and certainly for NJ's Staffing Industry.


Members and other staffing firms are encouraged to reach out to their Assembly representatives TODAY and use NJSA's Position Paper (click here to download) and its talking points to explain your opposition. There are real dangers and harm for future economic and employment growth associated with this bill for citizens and businesses in your district if it is passed by NJ's Legislature.


Workers' Compensation Costs


Legislation that would increase workers' compensation costs for most private employers in New Jersey is in position for a final legislative vote, which could happen before the end of March. If the Assembly approves the bill, it will be sent to the Governor for his consideration.

Assembly Bill 1908 imposes an annual cost-of-living adjustment (COLA) on workers' compensation benefit rates for certain disability cases that occurred after 1980. The extra money would be generated by increasing the surcharge employers pay on their premiums to maintain New Jersey's Second Injury Fund for injured workers. The most recent estimated cost after the three year phase-in period for a similar bill in the last legislative session was $58 million. Here is some additional information about the bill:


* Workers' compensation costs have been climbing. Rates have increased in recent years: 6.9 percent in 2012, 7.6 percent in 2013 and 3.6 percent in 2014. In a ranking of state workers' compensation premium rates, New Jersey went from 23rd in 2006 to 7th in 2012. This bill would significantly increase the cost of workers' compensation insurance.

* Costs absorbed solely by private employers. While both public and private-sector workers' compensation beneficiaries will benefit from the higher rates, the added expense will be borne solely by private-sector employers.


Contact your state Assembly members immediately and ask them to vote "NO" on raising your workers' compensation costs.

Manufacturing Increased at Modest Pace in March

Manufacturing activity in the Mid-Atlantic region increased at a modest pace in March, according to firms responding to the Federal Reserve Bank of Philadelphia's Manufacturing Business Outlook Survey. The survey's broadest measure of manufacturing conditions, at 5.0, was virtually unchanged from its reading of 5.2 in February. Firms' responses suggest weaker labor market conditions compared with most of last year. The percentage of firms reporting an increase in employees in March (17%) narrowly exceeded the percentage reporting a decrease (14%).

The future employment index also was weaker this month. The future employment index decreased 12 points, to its lowest reading since April 2013. Although nearly 57% of firms are expecting no change in their employment levels over the next six months, the percentage expecting increases in employment (25%) remained greater than the percentage expecting decreases (11%).
