Governor Christie Conditionally Vetoed S-992 "Equal Pay for Women and Employment Discrimination"

On May 2, 2016 Governor Christie conditionally vetoed S-992 (Concerning Equal Pay).  Even though the bill's supporters said it implemented the requirements of the federal Lilly Ledbetter Fair Pay Act of 2009, Governor Christie vetoed this bill due to several provisions which went far past the federal law.   Specifically he vetoed material segments of the bill which would have implemented the following:
  • The bill would have allowed for unlimited back pay, creating the real possibility of past decades of exposure to back pay liability.  He replaced it with the current federal and state precedent of two year limits.
  • The bill had a liberal and over-simplified standard to determine wage discrimination which essentially eliminated any fact-based evaluation of the workplace and positions.  He instead replaced it with language that reflects the current standard required by the New Jersey Supreme Court.
  • The bill would have allowed treble damages which is currently not allowed by state or federal law.  He removed treble damages from the bill. 
  • Finally the bill would have imposed new draconian reporting requirements on any firm supplying personnel services to the state.  He eliminated this provision entirely.
As NJSA's lobbyist Patrick Stewart of Public Strategies Impact reported to the Executive Leadership Conference on April 28, 2016, Governor Christie is the only hope for NJ's business community today from having dangerous and punitive legislation implemented.  Please send an email to Governor Christie's office thanking him for his veto of this harmful bill.

The bill now returns in its modified form to the Legislature for its consideration.  The options for the Legislature are to override the Governor's veto, vote to accept the Governor's version, or do nothing and the bill essentially dies.

Paid Sick Leave
The New Jersey Senate has scheduled a vote on S799, which would require all businesses in the state to offer their employees paid sick leave, for this coming Monday, May 9. NJSA urges its members to continue to contact their elected state officials to let them know of the severe economic impact this bill would have on businesses in NJ.
